NoteSparkAI is a private study tool. The notes, uploads, and AI outputs you create live in your own library and are not public. Even so, we comply with the Digital Millennium Copyright Act (DMCA) and respond promptly to valid notices regarding any content we host.
We also terminate the accounts of repeat infringers in appropriate circumstances.
Filing a takedown notice
If you are a copyright owner (or authorized to act for one) and believe your work has been copied in a way that constitutes infringement, send a written notice to our designated agent (below) that includes all six of the following:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material you say is infringing, with enough detail for us to locate it (URLs, account email, or a description).
- Your contact information — name, address, telephone number, and email.
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner's behalf.
Incomplete notices may not be actionable. Knowingly misrepresenting that material is infringing can expose you to liability for damages under 17 U.S.C. § 512(f).
Filing a counter-notice
If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notice to our designated agent that includes:
- Your physical or electronic signature.
- Identification of the removed material and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and phone number, and a statement that you consent to the jurisdiction of the federal court for your district (or, if outside the U.S., any district in which we may be found), and that you will accept service of process from the party who filed the original notice.
If we receive a valid counter-notice, we may restore the content in 10–14 business days unless the original complainant files a court action.
Repeat infringers
We maintain a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We may also remove content and suspend access at our discretion where we have a good-faith belief that infringement has occurred.
